Welcome to eggypc.com. These Terms of Service ("Terms") govern your use of our website and the purchase of goods and services from Eggy PC Services Ltd ("we", "us", or "our").

By visiting our site or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions. Please read these Terms carefully before accessing or using our website.

1. Business Information & Contact Details

  • Company Name: Eggy PC Services Ltd
  • Website: https://eggypc.com
  • Customer Support Email: support@eggypc.com
  • Governing Law: England and Wales

2. General Conditions & Account Terms

  • By agreeing to these Terms, you represent that you are at least the age of majority in your country, county, or state of residence.
  • You must not use our products or services for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction.
  • A breach or violation of any of the Terms will result in an immediate termination of your Services.

3. Custom PC Builds & Product Specifications

  • Custom Orders: Custom PC configurations built to order are tailored to individual client specifications.
  • Component Availability: Due to rapid technological changes and stock variations in the PC hardware market, individual component models may occasionally become unavailable. If a component in your custom build becomes unavailable prior to assembly, we will contact you to offer a comparable or higher-spec replacement before proceeding.
  • Compatibility: Our custom PC configuration tool and technical team ensure component compatibility. If you supply custom parts or ask for non-standard configurations, we will advise on compatibility, but cannot accept liability for performance bottlenecks resulting strictly from requested custom configurations.

4. Computer Repair & Technical Services

  • Data Backup Responsibility: Before submitting any device, storage medium, or custom system to Eggy PC Services Ltd for diagnostics, repair, or maintenance, you are solely responsible for backing up all existing data, software, and files. We take utmost care with customer hardware, but we accept no liability for data loss or corruption occurring during diagnostic testing or hardware repairs.
  • Diagnostics & Estimates: Diagnostic fees and repair estimates will be provided before work commences. If additional hardware defects are identified during testing, we will seek your authorization before proceeding with further paid work.
  • Unclaimed Hardware: Equipment left in our possession for repair that remains unpaid or uncollected for more than 60 calendar days after notice of completion may be disposed of or sold to recover diagnostic and labor costs, in accordance with applicable UK lien laws.

5. Pricing, Orders, and Payment

  • Pricing: All prices displayed on eggypc.com are in GBP (£) and are inclusive of applicable UK VAT unless stated otherwise.
  • Order Acceptance: Your receipt of an order confirmation does not signify our final acceptance of your order. We reserve the right at any time after receipt of your order to accept or decline your order for legitimate reasons, including stock errors, pricing errors, or failure of payment authorization.
  • Payment Terms: Full payment is required upon checkout for custom builds, hardware parts, and standard shop items before assembly or dispatch begins.

6. Shipping & Delivery

  • Delivery Windows: Delivery estimates provided at checkout are estimates only. While we make every effort to meet delivery schedules (including custom assembly and testing lead times), we are not liable for transit delays caused by third-party couriers.
  • Risk and Title: Risk in the goods passes to you upon physical delivery to the delivery address specified in your order. Title to the goods passes only upon receipt of full payment.
  • Inspection Upon Delivery: Please inspect packaging upon receipt. If courier damage is evident, please document it immediately and contact us within 48 hours.

7. Cancellation, Returns, and Refunds

Your rights to cancel orders and return products are detailed in our Return and Refund Policy and are governed by UK consumer law:

  • Standard Goods (14-Day Cooling Off): Under the Consumer Contracts Regulations 2013, you have 14 days from delivery to notify us of your intent to cancel an order for standard, non-bespoke hardware components or accessories.
  • Bespoke & Custom Builds: Under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013, the statutory right to cancel without reason does not automatically apply to goods made to the customer's specific specifications or clearly personalized. However, standard statutory warranty protections under the Consumer Rights Act 2015 for faulty or misdescribed goods remain fully applicable.

8. Warranties & Guarantee

  • Hardware Warranties: In addition to your statutory rights under the Consumer Rights Act 2015, custom PC builds and refurbished systems sold by Eggy PC Services Ltd come with our standard hardware warranty as specified at the time of purchase.
  • Exclusions: Warranties do not cover damage resulting from physical abuse, unauthorized third-party modifications, custom firmware/BIOS flashing outside manufacturer specs, excessive liquid exposure, extreme overclocking beyond factory specifications, or improper user installation of secondary components.

9. Limitation of Liability

  • Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by English law.
  • To the maximum extent permitted by law, Eggy PC Services Ltd shall not be liable for any indirect, incidental, or consequential losses, loss of profit, loss of data, or loss of business opportunity arising out of or in connection with the purchase or use of our hardware or services.

10. Governing Law & Jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
